This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("End-User" or "you") and Kuma Stories Ltd ("Developer," "we," "us," or "our"). This Agreement governs your use of the Doku mobile application (the "Licensed Application") and any related services.
By downloading, installing, or using the Licensed Application, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not use the Licensed Application.
1. Acknowledgement
You and KumaStories Ltd acknowledge that this EULA is concluded between you and KumaStories Ltd only, and not with Apple Inc. ("Apple"). KumaStories Ltd, not Apple, is solely responsible for the Licensed Application and the content thereof. The usage rules for the Licensed Application are subject to the Apple Media Services Terms and Conditions.
2. Scope of License
KumaStories Ltd grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
3. User-Generated Content (UGC) and Moderation
The Licensed Application allows users to submit ideas, interact with AI to generate scripts, and post comments (collectively, "User-Generated Content" or "UGC").
Zero Tolerance Policy: We maintain a strict, zero-tolerance policy against objectionable content and abusive behavior. You agree NOT to use the Licensed Application to create, submit, or share content that is:
- Defamatory, discriminatory, or mean-spirited (including hate speech based on race, religion, gender, or sexual orientation).
- Harassing, bullying, or threatening to any individual or group.
- Sexually explicit or pornographic.
- Encouraging of violence, illegal acts, or self-harm.
- Infringing on the intellectual property rights of others.
Enforcement: KumaStories Ltd reserves the right to review, filter, and moderate all UGC. We provide in-app mechanisms to report offensive content and block abusive users. We commit to acting on objectionable content reports within 24 hours. Users found violating this policy will have their content removed and their accounts permanently banned without prior notice.
4. AI-Assisted Content Creation and Intellectual Property
The Licensed Application provides features that allow you to collaborate with Artificial Intelligence ("AI") to generate story ideas, scripts, and related content.
- Your Inputs: You retain all ownership rights to the original text, prompts, and ideas you input into the Licensed Application ("Inputs"). You represent and warrant that your Inputs do not violate the intellectual property rights of any third party.
- AI-Generated Outputs: The scripts, text, and media generated by the AI based on your Inputs ("Outputs") are provided to you under a non-exclusive license for personal, non-commercial use within the Doku platform.
- Platform Rights: By submitting Inputs and generating Outputs, you grant KumaStories Ltd a worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Inputs and Outputs for the purpose of operating, improving, and promoting the Licensed Application, including producing "Produced UGC Series" (Layer 3 content) for distribution on the platform.
5. Maintenance and Support
KumaStories Ltd is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law. You and KumaStories Ltd acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
6. Warranty
KumaStories Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of KumaStories Ltd.
7. Product Claims
You and KumaStories Ltd acknowledge that KumaStories Ltd, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
8. Intellectual Property Rights
You and KumaStories Ltd acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, KumaStories Ltd, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
9. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
10. Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application.
11. Third-Party Beneficiary
You and KumaStories Ltd acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
